KEMBALI KE UUD 1945, SEBUAH PILIHAN AKAL SEHAT, DAN LEBIH MENGHARGAI DAN MENGHORMATI PARA PENDIRI BANGSA & NEGARA

Many opinions say that the Constitution as a result of the AMENDMENT is false. There are also no less many of those who have put forward ideas and ideas to return to the original 1945 Constitution.

This idea is motivated by the fact of socio-political and economic life that benefits the rulers and capital owners, among others through the MINERAL and MINERAL Law and the Job Creation Law, another name for the OMNIBUS LAW. It is further exacerbated by the increasingly widespread division of society, and the flood of foreign workers from China. .

Meanwhile, the natives, who are the majority of Muslims, are increasingly marginalized, both economically and politically. It is not uncommon for Muslims to be the target of endless stigmatization. Among others, with the labels of radical, anti-diversity, intolerant, terrorist and anti-NKRI.

In fact, those who are intolerant and anti-NKRI are minorities who want to straddle the wealth of this country to the extreme.

How not, 1% of the Indonesian population controls around 45-59% of the national wealth (Chusnul Mar'iyah, Phd, lecturer of FISIP UI and Siti Khairun Ni'mah).

From these facts, how extreme is the gap between the rich and the poor. Not to mention that 72% of productive land in Indonesia is also controlled by 1% of the Indonesian population.

O state administrators. And the party owners in this country. Do you feel innocent that the amendment to the 1945 Constitution has in essence betrayed the struggle of the country's founders. And betrayed the freedom fighters.

The country's founders have toiled without pay, sometimes bloodied, from morning, noon and night. Sometimes I don't sleep either. Formulating the provisions of a very historical and monumental article, to provide signs in the management of the Indonesian state in the future.

One of them is when they formulated articles related to the economy and the welfare of the people, the founders of the state were very careful, careful and wise in formulating the provisions of article 33 of the 1945 Constitution.

In article 33 of the 1945 Constitution before the amendment, it only consisted of 3 paragraphs, which in essence emphasized the principle of togetherness and family. The earth and water, including all the natural resources contained in it, as well as the branches of production that are important and control the LIFE OF THE PEOPLE are CONTROLLED by the STATE, and used to the greatest extent for the prosperity of all Indonesian people.

But the fact is that after the amendment of the Constitution, the wealth of natural resources is almost entirely controlled by about 1% of the Indonesian population. Because after the amendment of the Constitution, based on article 33 paragraph 4, the national economic system is organized based on the basis of economic democracy. So the pressure point is on the democratic aspect, which tends to be LIBERAL and CAPITALISTIC.

The national economy should be built on the basis of togetherness, which synergizes with the principle of kinship. The government must adhere to the provisions of article 33 paragraphs 2 and 3.

If they deviate from the principles that have been affirmed in article 33 paragraphs 1, 2 and 3 of the 1945 CONSTITUTION, then the rich (the conglomerates) will increasingly grip the weak, most of whom are Muslims and natives. Especially among workers, farmers, fishermen and MSMEs.

The question is, in what way can 1% of the Indonesian population control national assets to the extreme as mentioned above? In this regard, the author agrees with the KPK, the Chairman of the People's Consultative Assembly of the Republic of Indonesia, researchers, observers and academics, that our democracy has been overflowing with illegal money waste, which comes from power brokers who want to accelerate the Republic of Indonesia under their grasp. It's a shame that so many people are so rich, and their lives are everywhere.

Based on the facts as mentioned above, are they still worthy of shouting "I am Pancasila, I am Indonesian, and I am anti NKRI, I am anti Pancasila, I am anti-tolerance, and I am anti-diversity, etc. Are they unaware or pretend to forget, that the 1% of the Indonesian population who almost control all the wealth of this country is inseparable from the role of the KACUNG who have raped the values of Pancasila, especially precepts 2, 3 and 5.

To them, this should be labeled intolerant, because they are super greedy in this country. For this reason, do not be surprised if various circles loudly voice the idea of returning to the original 1945 Constitution, as a common sense choice.

Indeed, there are also those who argue that the current 1945 Constitution is fake, but I am of the opinion that the amended Constitution is legal, official and not fake. Because the amended Constitution was born from a political decision as a result of the 1999 election which was relatively better than the previous periods, except for the first election in 1955.

In my opinion, the amended CONSTITUTION that is still in force today is LEGALLY DEFECTIVE.

It is said to be LEGALLY FLAWED, because actually the amended Constitution only consists of 15 chapters. Why should it be written consisting of 16 chapters. In this case, CHAPTER IV on the SUPREME ADVISORY COUNCIL (DPA) has been abolished. Practically there is no Chapter IV about the Supreme Advisory Council (DPA).

The existence of Chapter IV, which is still stated in the amended Constitution, is meaningless, aka fraudulent and super funny. Because there is a CHAPTER IV without an article and has been deleted, but it remains a separate CHAPTER. It shouldn't be there.

Then CHAPTER V should be CHAPTER IV, CHAPTER VI should be CHAPTER V and so on. So that the amended Constitution only consists of 15 chapters instead of 16 chapters.

Because it is LEGALLY flawed, the amended Constitution can be NULL AND VOID, or it can be CANCELED. Null and void, meaning that the amended Constitution is considered to have never existed. Meanwhile, if it can be canceled, then the amended Constitution is void after there is a legal/political action in the form of cancellation of the amended CONSTITUTION.

As a political pundit, I agree and agree to cancel and return to the original 1945 Constitution. Which was ratified on August 18, 1945, and which has been re-enacted through a Presidential Decree on July 5, 1959.

With consideration, legally and politically it is more practical. It is simpler, more efficient, and in accordance with the personality of the Indonesian nation. It is not liberal and not capitalistic. More specially, it appreciates and respects the struggle of the founders of this nation and country.

Furthermore, regarding issues that have not been regulated in detail in the original 1945 Constitution, it can be stated in the form of laws or laws and regulations that are elaborations of the Constitution, through the constitutional mechanism that has been agreed, according to challenges and needs.

Thus, it can save political costs which are currently soaring and tend to be transactional. The buying and selling of people's voting rights can be suppressed. The envelope virus or the barter of money and political power can be prevented, at least it can be suppressed to a minimum.

If it continues to survive as it is today, the door will be wide open for CUKONG owners who want to hunt for investment in politicians and party rulers.

Because based on research from various NGOs and also from various KPK catches, not a few of our officials have talent and like to be pet DRIVERS.

On the other hand, there are also many cukongs who like and like to maintain KACUNG, in order to facilitate the modus operandi of robbing the assets of IBU PERTIWI which is famous for gemah ripah loh jinawi, rich in forests and mines.

But it is all up to the people and the people's representatives, if they still believe it.
